Environmental Justice – What is it and what will it mean for my business or my clients?

Environmental Justice is a policy that seeks to address the environmental burdens that are disproportionately borne by marginalized and disadvantaged communities. The federal government and many states, including Massachusetts, have recently implemented laws and policies to evaluate the cumulative impacts of industrial, commercial, redevelopment, utilities and infrastructure projects to ensure they do not add to the quantified burdens in these communities, which are measured by a wide range of factors including race, ethnicity, economic class, education, and health outcomes.

The growing influence of the environmental justice movement presents both opportunities and challenges to business decision-making and will alter the legal analysis supporting those decisions, including permitting, community relations, financial disclosures, ESG reporting, and corporate governance.
